These general terms and conditions apply strictly to all sales of products or services associated, made by FORNITURAS DE JOYERÍA S.A. to professionals and complement the provisions of the Legal Notice.
The website is mainly intended for users residing in Spain, FORNITURAS DE JOYERÍA S.A. does not ensure that the website complies with the laws of other countries, either in whole or in part.
Any order placed with FORNITURAS DE JOYERÍA S.A. through any of its web pages, www.orobase.es, www.jewelryfindings.eu or www.appretsdebijoux.fr, implies as an essential and determining condition, the unreserved acceptance by the Client of these General Conditions of Contract, as well as the particular conditions that, where appropriate, are included, through the publication of these modifications on the web pages and the shop, so that they can be known by the clients, stating the date of the notifications.
During the purchase process, the user will be considered a customer.
- The provider undertakes to ensure that the content, data or information regarding the products or services offered on its website are reliable, accurate and truthful, and is therefore responsible for the prices and features advertised. However, it shall not be held responsible for any information that has been introduced, displayed or modified by third parties outside the provider.
- FORNITURAS DE JOYERÍA S.A. reserves the right to interrupt access to the website, as well as the provision of any or all of the services provided through the web pages www.orobase.es, www.jewelryfindings.eu and appretsdebijoux.fr, at any time and without prior notice, whether for technical, security, control or maintenance reasons, due to power failures or for any other justified cause.
- Furthermore, FORNITURAS DE JOYERÍA S.A. assumes no liability whatsoever for, including but not limited to, the following:
1) Mistakes or damage caused to the websites due to inefficient use of the service and in bad faith by third parties.
2) The use of the materials provided on the websites by third parties in breach of the intellectual and/or industrial property rights of the web content.
3) Problems in the email address or non-operability of the same, which has been provided by the customer for sending the requested information.
4) Possible damages and losses to clients caused by normal or anomalous functioning of the tools, contents and/or access to both websites and, in general, those mistakes or problems that are generated in the development or instrumentation of the technical elements that make up both websites.
5) Failures or incidents that may occur in communications, deletion or incomplete transmissions, so that there is no guarantee that the services of the websites are constantly operational.
6) Mistakes or delays in access by the client when accessing either website at the time of entering their data in the corresponding form or any other anomaly that may arise when these incidents are due to problems in the Internet network, fortuitous events or force majeure or any other unforeseeable contingency beyond the good faith of FORNITURAS DE JOYERÍA S.A.
- In any case, FORNITURAS DE JOYERÍA undertakes to solve all those problems that may arise within its competence, and to offer the necessary support to the customer to achieve a satisfactory and rapid solution to the incident.
I) Every client of the web portals is obliged to use the services diligently, as well as to comply with the instructions for use and warnings contained in these conditions of contract and use. By way of example and without limitation, the client undertakes:
a) To provide truthful information about the data requested on the user registration form and when placing the order.
b) Not to use false identities or impersonate the identity of third parties either during the registration phase or when contracting products in the online shop.
c) Not to introduce, store or disseminate information or material that in any way infringes fundamental rights, public freedoms, privacy, the image of third parties, honour and, in general, current legislation.
d) Not to introduce, store or disseminate through the shop any program, data, virus, code or any other physical or electronic device that may cause damage to the web portals, any of the services, equipment, systems or networks of FORNITUAS DE JOYERÍA S.A., any other customer or any third party in general.
II) The customer who makes a purchase through the web portals undertakes to provide a postal address to which the order can be delivered within the normal delivery schedule of goods. In the event of non-compliance by the client with this obligation, FORNITURAS DE JOYERÍA S.A. will not be held responsible for the impossibility of delivery of the order requested.
III) All customers will be liable for damages of any kind that they may suffer as a result of the breach of any of the obligations previously stated by FORNITURAS DE JOYERÍA S.A., as well as any others included in these General Conditions and/or those imposed by the Law in relation to the use of the website.
IV) FORNITURAS DE JOYERÍA S.A. reserves the right to update the contents, as well as to remove, limit or prevent access, temporarily or permanently when it deems appropriate, as well as to deny access to the websites to any user who misuses the contents and/or breaches any of these General Conditions.
V) The user declares to be over 18 years of age and to have the legal capacity to enter into contracts through this website.
VI) FORNITURAS DE JOYERÍA S.A. will at all times ensure that the current legal system is respected.
VII) FORNITURAS DE JOYERÍA S.A. reserves the right to cancel any order that does not meet the requirements set out in these conditions, as well as to cancel orders due to errors in price or errors in stock.
I) The user can place their order by selecting the product or products they wish, at which point these products will be added to their account after clicking on the "Buy" button.
II) During the process, the customer can freely add or remove products from the account.
III) Once a product has been selected, the customer can return to the catalogue to continue selecting products.
IV) When no more products are to be selected, the purchase will be finished by clicking on the "Finish order" button. When the customer has completed and confirmed the order, the client must accept and commit to these general terms and conditions.
V) After confirming the order, FORNITURAS DE JOYERÍA S.A. will send the customer an e-mail with the details of the order and the products purchased as proof of the economic transaction. If you do not receive it within 24 hours, please contact us through our e-mail: info@orobase.es or telephone: 34-915310207 because there may have been a failure to enter an invalid email or an error in our system. In the same way, if the customer has any problems with the chosen method, please do not hesitate to contact us, we will be happy to help.
VI) The order confirmation email is automatically generated by the system as a proof of receipt of the order. However, this confirmation does not imply automatic acceptance of the order, since FORNITURAS DE JOYERÍA S.A. reserves the right to collect additional information related to identity and address to guarantee both the correct delivery of the order and to ensure the absence of fraud related to transactions.
VII) FORNITURAS DE JOYERÍA S.A. may refuse to process the order, or not be able to proceed with such processing, in the following cases, without limitation:
When the product ordered has ceased to be manufactured or is no longer available.
When the product has been purchased at a price that does not correspond to its value due to a system error.
When the merchant of your credit or debit card does not authorise payment of the purchase price.
If for any reason or mistake, the information specified at a given time may not reflect the exact situation when placing an order, (for example, a mistake in stock and the product purchased is out of stock) we will contact the Customer by the telephone or email provided. The Customer will have the option to wait until the product is available, choose another product with similar characteristics or cancel the order. If the order is cancelled, we will refund the amount paid.
Customers who have purchased a product at a lower price due to a system error will be automatically cancelled and a refund will be made, and the order cannot be reclaimed. The customer will be contacted before to inform them of the error.
VIII) The invoice will be sent to the customer with the order.
I) Any order is subject to product availability.
For deliveries in Iberian peninsula, the estimated delivery time is 24/48 working hours from the time the product leaves the warehouse, with some exceptions. During the Christmas season or special promotions, orders may be subject to delivery delays.
Delivery times outside the Iberian peninsula will be communicated once the destination address is entered. These may be subject to customs charges which must be paid by the customer. FORNITURAS DE JOYERÍA S.A. will not be responsible for such payments and the rejection of the goods by the customer will result in the customer being charged for the costs of such shipments and returns.
Orders placed on public holidays will be counted as having been placed on the following working day.
All orders placed after 12.00 p.m. will be processed as of the following working day.
Public holidays do not count as a delivery day.
No deliveries are made on Sundays or holidays, there are localities that do deliver on Saturdays, but we can only guarantee deliveries from MONDAY TO FRIDAY.
FORNITURAS DE JOYERÍA S.A. assumes no responsibility when the package is not delivered or is delayed because the information provided by the user is false, inaccurate or incomplete, or when the delivery cannot be made for reasons such as the absence of the recipient, error or failure of the transport agency or the retention of the package in Customs.
In the event that the delivery date cannot be met, we will inform the user of this circumstance and the user will be offered the option of continuing with the purchase by setting a new delivery date or the possibility of cancelling the order and obtaining a full refund of the price paid. The customer must bear in mind, in any case, that deliveries are not made on Saturdays or Sundays.
II) If we do not have any particular product in stock or if there is not the required quantity of any product, FORNITURAS DE JOYERÍA S.A. will contact the customer by telephone to inform him/her of the estimated delivery time of the product in question.
III) FORNITURAS DE JOYERÍA S.A. reserves the right to decide at any time the products that appear and that are offered to users through the websites, being able in any case to exclude products and include new products that join the existing ones, this being governed, unless otherwise stated, by the provisions of the General Conditions that are in force at that time.
IV) The products will be sent to the delivery address provided by the customer. In the case of placing an order for several items with different availabilities FORNITURAS DE JOYERÍA S.A. will contact the customer by any means to inform him of the availability and delivery times, so that, he can choose between receiving a shipment on the date that he is informed or several partial shipments to complete the entire shipment.
V) In the event of a stock shortage or unavailability of the article, FORNITURAS DE JOYERÍA S.A. will contact the user to immediately communicate a new delivery date.
VI) If it is not possible to deliver the requested product, it will be cancelled and the customer will be offered another product with similar characteristics to the one chosen.
VII) Delivery times are approximate and may be brought forward or delayed in specific cases. We will always try to comply with the deadlines indicated. In any case, a delay in delivery with respect to the deadlines indicated will not entitle the customer to claim any compensation.
I) The products offered on the websites together with their prices and characteristics will appear on the screen.
The prices indicated for the products do not include taxes.
Prices may be modified by FORNITURAS DE JOYERÍA S.A. at any time and without prior notice without affecting orders already confirmed.
FORNITURAS DE JOYERÍA S.A. will not be obliged to fulfil orders when the price is incorrect, especially when the error is obvious and easily recognisable.
II) At the time of purchase the customer is informed of discounts, taxes and shipping costs, if applicable, as well as special conditions for customers in the Canary Islands, Ceuta and Melilla.
The cost of international shipping will depend on the destination country. It can be consulted in the shopping cart when entering the address.
III) The prices and offers presented in the online shop are valid for orders placed directly from the website. The validation of the order by the user implies knowledge and acceptance of these General Terms and Conditions as part of the conclusion of the contract.
I) The payment methods available on our website are: Credit card, bank transfer or cash on delivery.
II) Cash on delivery is only available for some destinations. In this case, the customer will pay on receipt of the goods to the transport agency that delivers the package
III) Credit or debit card. The website will redirect you to our payment gateway to complete the purchase. The whole process is carried out in a safe way.
If the courier delivers the package by mistake without requesting payment from the client, the client will not be exempt from this payment, but will have a debt with FORNITURAS DE JOYERÍA S.A. that must be settled, either by payment via bank transfer or by returning the courier to the address to collect the payment.
From certain amounts, duly specified on our website, shipping costs and insurance will be borne by the company. For lower amounts the costs will be borne by the customer, informing the customer at all times of the amount before confirming the order.
I) If the customer is not satisfied, he/she may return or exchange the product and exercise his/her right of withdrawal on the purchase made in the online shop during 14 working days following receipt of the order, provided that the following circumstances are met:
a) Product defective in origin: The customer must send it back at our expense. Once FORNITURAS DE JOYERÍA S.A. receives the defective product and verifies the original defect, it will be replaced and sent to the customer. The exchange will always be made for the same article or reference requested by the customer. Only the first shipment will be invoiced, and FORNITURAS DE JOYERÍA S.A. will be responsible for the return and new shipment costs.
b) Product that by mistake does not correspond to your order: We will proceed as in the previous case and verified the error will proceed to send the correct product. FORNITURAS DE JOYERÍA S.A. will also assume, in this case, the shipping costs of the wrong product and delivery of the product corresponding to the order placed.
c) Product ordered that does not satisfy the customer: The costs and risks associated with the return of the product shall be borne by the customer, who must send them safely and with the necessary guarantees that the returned goods arrive in perfect condition. Once the product has been correctly received, FORNITURAS DE JOYERÍA S.A. will proceed to reimburse the amount paid, including the initial shipping costs.
II) In any case, the article to be returned or exchanged must be correctly packaged for its return.
III) To proceed with the return or exercise of withdrawal, the customer must include in the package the original invoice and the item to be returned for refund.
IV) In the event that FORNITURAS DE JOYERÍA S.A. considers that the return or exchange of the purchased product or the reimbursement of the amount is not appropriate, it will contact the customer by any means, who will be able to exercise their corresponding rights in the instance they consider. In this case, the returned product will remain at the customer's disposal for collection, withdrawal or reshipment for a period of one month. In the event that the customer chooses to return the product, the costs shall be borne by the customer.
FORNITURAS DE JOYERÍA S.A. will not refund any amount or make any reshipment of goods as long as it has not verified the receipt and packaging of the item being returned or exchanged. The price to be refunded is the one that originally appeared in the order, except for the return costs, which will only be refunded if FORNITURAS DE JOYERÍA S.A. is responsible for the reason for returning the product.
Once the correct condition of the returned product has been verified, the amount will be refunded within a maximum period of 30 days from the date of withdrawal or termination of the contract.
FORNITURAS DE JOYERÍA S.A. guarantees the quality of its products for a period of two years from the date of receipt of the goods, strictly applying Law 17/1985 of 1 July 1985 on objects made of precious metals.
The customer who receives a product with any defect may return it free of charge, to be replaced as soon as possible.
This guarantee does not include defects caused by negligence, knocks, incorrect use, improper handling, wear and tear due to normal use, etc., and therefore products with these defects will not be replaced or exchanged.
As indicated in section 11 of these general contracting conditions, for any exchange or return it is essential to present proof of purchase, which must be sent by email info@orobase.es.
The data provided for the economic transaction will be incorporated into an automated file property of FORNITURAS DE JOYERÍA S.A. (owner of the web pages www.orobase.es, www.jewelryfindings.eu and www.appretsdebijoux.fr), called "Clients" in order to be able to carry out the present contract and to inform you about the new products.
You may exercise your rights of access, rectification, erasure, restriction of processing, portability and objection by writing to info@orobase.es.

In order to submit complaints regarding the use of our services, you may contact us by mail at the electronic or physical address indicated above, and in all cases you must resort to a friendly solution in the first instance.
For the resolution of any dispute arising from the purchase of products or that concerns our website or any of those that depend on it, Spanish law shall apply, and in case of dispute, both parties agree to submit to the user's own jurisdiction and provided that the user has acquired the status of consumer in accordance with Real Decreto legislativo 1/2007, of 16 November, which approves the revised text of the Law on Consumers and Users and other complementary laws. Otherwise, for the resolution of disputes, the Courts and Tribunals of Madrid shall have jurisdiction.
